This software license is an agreement between you (licensee) and Thermotron (licensor).

This software is protected by trade secret law and by the United States Copyright Laws and International Treaty Provisions. You may not copy or transfer this software in whole or in part except as provided below.

This Agreement permits you to A) use this software only with equipment identified to Thermotron, B) use this software on any other equipment you own but only to the extent that such use is necessary for your use of the equipment identified to Thermotron, and C) duplicate this software solely for archival backup purposes.

Thermotron retains ownership of all copyrights, designs, patents, and trade secrets embodied in or relating to the software provided by Thermotron. The software may include source code provided by Thermotron for "application specific" software written uniquely for Licensee's particular application. Licensee (and only Licensee) is granted the right to prepare a derivative work by modifying such source code but only with prior written authorization of Thermotron. Licensee agrees to assign and hereby does assign copyright in the derivative work to Thermotron.

The software (whether in object or source code and whether or not modified by Licensee) is provided "as is" with no warranties whatsoever, either expressed or implied, including without limitation, warranties of fitness for a particular purpose. Thermotron does not warrant that the functions contained in the software will meet Licensee's requirements, or that the operation of the software will be uninterrupted or error free.

Any alterations or changes to the software provided by Thermotron and not authorized by Thermotron in writing will void the Thermotron warranty on the equipment provided by Thermotron.
